The Services are available to education institutions (“Customers”), teachers and other education professionals (“Teachers,” “Administrators,” “you,” “your”) to use in conjunction with their students (“Students”) whom they are responsible for overseeing in the Services.
PERSONAL INFORMATION WE COLLECT
We collect the following personal information through the Services:
Information You Provide.
Customers. When your educational institution agrees to use the Services, the Customer provides us with their first and last name, email address, password, as well as the school/district name, an organization identifier, display name, street address, including city, state, postal code, and country, and at their option, a phone number. We use that information to create the school or district account, create the Customer profile, and then to send an email to the Customer inviting them to access their account. The Customer then provides that same information about its Teachers and Administrators, as well as their roles, in order to create their accounts. Once accounts are created, an email is automatically sent to the Teachers and other Administrators to access the Services.
Teachers and other Administrators. Teachers are then required to provide us with a class name, the grade and type of class (RTI, ELL, Special Ed, Other). At their discretion, Teachers and Administrators may also provide us with a phone number, gender, as well as subject and location (for example, a room number) for their class.
We use the information to create the accounts, provide you with access to your user profiles, allow you to see your students’ activity in the Services, and to respond to your requests to receive support, respond to questions, communicate with you regarding Service-related updates, or to send you marketing and other communications from us when you have opted in to receiving that information.
At their option, Administrators may submit contact information of district or school contacts who are not Square Panda users, such as IT personnel or program coordinators. Information includes first and last name, type (technical or secondary contact), email address and phone number. This information may be used to send essential Square Panda updates to support personnel.
Students. Teachers and Administrators may also provide us with the first and last names of the students who will use the Services. At their option, Teachers or Administrators may also provide a nickname, date of birth, gender, parent email address, student ID, grade level, IEP and languages the child might be familiar with, as well as photos of students or avatars. We use this information to permit students to access the Services, and to provide the Services under the direction of the Customer, including to provide reporting to the Customer on their student activity and progress in the Services.
SPECIAL NOTE ABOUT CHILDREN’S PRIVACY
We operate under the requirements of the Children’s Online Privacy Protection Act (“COPPA”). By using Square Panda, you represent that you have obtained the necessary parental consent for collection of personal information from your students for the purpose of providing the Services. In addition to the information that we collect automatically as described below, we also provide open text fields that are intended for children to use when tracing letters and spelling words. We also provide games that permit Students to record their voice, however these recordings are stored on the device and are deleted when the Student either finishes the game or exits Square Panda.

Information that we collect automatically
When you and your Students use our Service, we may collect certain information automatically from your device and associate it with your account information. This information may be considered personal information under applicable data protection laws.
We collect this information in a variety of ways, including:
Local Storage: We may use, collect, and store information locally on your device to enable log in using mechanisms such as browser web storage and application data caches.
Device Information: We collect device-specific information such as your device type, device brand, machine model, operating system, hardware version, browser type and version, file and software names and types, battery and signal strength, and device identifiers, as well as default language. This helps us measure how the Services are performing and optimize Square Panda for you on your particular device.
Server Log Information: Like most online services, when you use the Services, we automatically collect and store certain information in our server logs such as:
Our Services are also designed to capture in-app events, such as how a Student progresses through a game and Student responses to in-game questions.
Collecting this information enables us to analyze trends, save your progress, administer the Services and to better understand the users of our Service, where they come from, and what content or features on our Services most enable students academic progress. We use this information to provide reports to our Customers and Teachers about the work their Students have done in our Services, provide recommendations for content based on the Students’ progress, for our internal research development and analytics purposes, to prevent fraudulent behavior in our Service, and to improve the quality and relevance of our Service to our players and visitors.

HOW WE MAY USE YOUR PERSONAL INFORMATION
We do not sell personally identifiable data. We collect and use your personal information for the purposes described above and to:

SHARING YOUR PERSONAL INFORMATION

Our service providers and subcontractors who process your information only on our behalf and according to our instructions. These partners provide data processing services to us, for example, to provide (i) data hosting, (ii) marketing and advertising services for Customers, Teachers and Administrators who have opted in to receive such information, (iii) user support, (iv) analytics for Services as well as (v) development and maintenance;
Any authorized law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person; and
HOW DO WE KEEP YOUR PERSONAL INFORMATION SECURE?
The security of your Personal Information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, in order to protect it from unauthorized access, destruction, use, modification, or disclosure.
Specific measures we use include the use of firewalls, encryption in transit, access keys, and rule/role based access procedures to ensure that only those of our employees, who on behalf of their work are entitled to process personal information, are entitled to use a system containing personal information. The information is collected into databases that are protected by firewalls, passwords and other technical measures.
However, please be aware that no method of transmission over the internet, or method of electronic storage is 100% secure and we are unable to guarantee the absolute security of the Personal Information we have collected from you.
HOW YOU CAN ACCESS AND MODIFY YOUR INFORMATION
At any time, you may access, amend, correct or delete information about your Students through the Teacher Portal dashboard available in the Services, by emailing us at firstname.lastname@example.org or calling us at (877) 80 PANDA (877-807-2632).
If you wish to access, correct, update or request deletion of your personal information, you can do so at any time by contacting us at email@example.com or by calling (877) 80 PANDA (877-807-2632).
Opt Out. We do not knowingly send emails to students, and we do not share your or your student information with third parties for marketing purposes.
You may sign up to receive email updates about our products, and you may opt out of receiving emails from us by clicking on the “unsubscribe” link found at the bottom of each email. If you have opted out of receiving emails from us, we may still send essential communications, such as legal notices or password change information to you as needed.
We retain your personal information as long as you retain an active account with us. We will delete your personal information sixty (60) days after expiration of a Customer contract. However, if at any time you would like to request deletion of personal information associated with your account, you may send us a written request to firstname.lastname@example.org and we will delete the requested information within forty-five (45) days. We will retain de-identified information for the purposes listed above.
